Overview
These general terms and conditions (hereinafter referred to as T&Cs) regulate the relationship between ivilounge GmbH (hereinafter referred to as “ivilounge”) and the customers (hereinafter referred to as “customer”).

2. Cosmetic Service
Ivilounge provides non-invasive and minimally invasive cosmetic treatments as a service. As far as legally required, the treatments are carried out under specialist medical supervision. The duration of the treatment depends on the agreements in the individual case. The treatment time begins at the agreed time. An extension of the booked treatment is only possible spontaneously if other appointments are not affected.
2.1 Making an appointment for cosmetic services
Anmeldungen zu Terminen sind verbindlich. Sollte der Kunde nicht in der Lage sein einen Termin wahrzunehmen bitten wir Sie, sich mindestens 48 Stunden vorher telefonisch oder schriftlich (Brief oder Email) abzumelden. Über das Wochenende innerhalb von 72 Stunden. Falls die Abmeldung verspätet oder nicht rechtzeitig erfolgt, wird die jeweils gebuchte Behandlung oder mindestens CHF 100 verrechnet. Dies gilt auch für gratis Beratungen. Die gewählte Kosmetikerin ist nicht bindend und kann durch eine andere ersetzt werden.
2.2. Rechnungsstellung und Zahlungsbedingungen bei kosmetischen Dienstleistungen
Rechnungen für Behandlungen sind innert 30 Tagen nach Rechnungsstellung zu begleichen. Werden die Gebühren nicht fristgerecht bezahlt, können Verzugszinsen und weitere Kosten anfallen. Offene Forderungen und Betreibungen können an Dritte weitergegeben werden.
The patient agrees that the treating physician will provide the data required for invoicing and debt collection to ivilounge GmbH, based in Zurich 8008, Dufourstrasse 90.

3. Medical service
Ivilounge provides private medical services in the field of aesthetic dermatology. These terms and conditions and the medical information on the homepage are not a substitute for advice and/or treatment by doctors.

3.1 Making an appointment for medical services
The treatment is based on the agreements in the individual case. The treatment time begins at the agreed time. An extension of the booked treatment is only possible spontaneously if other appointments are not affected. Registrations for treatments are binding. If the customer is unable to attend a treatment appointment, we ask that you cancel at least 48 hours in advance by phone or in writing (letter or email). Over the weekend, within 72 hours. If the cancellation is made late or not on time, the booked treatment or at least CHF 100 will be charged. This also applies to free consultations.

3.2 Rechnungsstellung und Zahlungsbedingungen bei medizinischen Dienstleistungen
Invoices for treatments must be paid within 10 days of the invoice being issued. If the fees are not paid on time, interest on arrears and other costs may be incurred. Outstanding claims and debt collection proceedings may be passed on to third parties (see section 10 of these General Terms and Conditions for release from professional secrecy).
The patient agrees that the treating physician may transfer the data required for invoicing and debt collection to ivilounge GmbH, based in Zürich 8008, Dufourstrasse 90 zur Verfügung stellt.

3.3 Finanzierungsbedingungen bei medizinischen Dienstleistungen
Bei Ratenzahlungen gelten folgende Konditionen.

MF Group AG acts as a billing company and can, if necessary, transfer the claims transferred to it to its financing partner in Germany for the purpose of billing and enforcement. MF Group AG and its financing partner are subject to the relevant provisions of Swiss, German and European data protection law and process patient data with the utmost care and absolute confidentiality under their own responsibility.
Für dieses Abrechnungsverfahren setzen wir im Falle einer Ratenzahlung Ihr Einverständnis voraus:
Sie erklären sich hiermit einverstanden mit der Weitergabe der zum Zweck der Bonitätsprüfung, Abrechnung (inkl. Abtretung der Forderung) und Geltendmachung der Forderung jeweils erforderlichen Personendaten und weiteren Informationen, insbesondere Daten aus der Patientenkartei (Name, Geburtsdatum, Anschrift, Behandlungsdatum) an die MF Group AG. An den Finanzierungspartner in Deutschland dürfen zur Bearbeitung in eigener Verantwortung übermittelt werden: Name, Anschrift, Geburtsdatum, Rechnungsbetrag und interne Identifikationsmerkmale, z.B. Kunden-ID). Falls die Forderung notfalls gerichtlich geltend gemacht werden muss, wird ihr Arzt auf Anfrage der MF Group AG auch den Behandlungsgegenstand gegenüber der MF Group AG und ihrem Finanzierungspartner offenlegen.
You hereby release your doctor from his or her duty of medical confidentiality to the extent that this is necessary for the credit check, billing (including assignment(s) of the claim) and enforcement of the claim.
Your consent also applies to future treatment; you can revoke it at any time with immediate effect for the future.
You hereby confirm that you are legally competent and at least 18 years old.

4. Terms of Sale (Online Shop)

5. Liability
Liability in the context of cosmetic treatments
The customer must notify us of obvious treatment defects in writing within 3 calendar days after he or she has been able to identify the defect. Otherwise, warranty rights are excluded. Further warranties and guarantees, including with regard to the compatibility and success of treatment methods and products used, are not provided.
The liability of ivilounge and its vicarious agents is limited to gross negligence and intentional acts. The above limitations of liability do not apply in the case of culpable injury to life, body or health, or to the quality of the product or fraudulently concealed defects. In the event of a breach of essential contractual obligations, any claims for damages are limited to typical and foreseeable damages. Liability under the Product Liability Act remains unaffected.
Claims for damages against ivilounge expire three months after the contractually agreed termination of treatment, unless the claims are asserted within this period.
ivilounge cannot be held liable for damages caused by incorrect information and/or omission of essential information by the customer.

6. Treatment of minors
Ivilounge does not provide medical treatment to minors.

7. Vouchers
Vouchers can only be used to pay for treatments that are offered at the time of redemption and during opening hours.
The vouchers we offer for treatments are valid for their defined period of time. The voucher must be redeemed within the validity period of the voucher. After this period, no extension is possible. The vouchers expire at the latest 12 months after they are issued, unless otherwise stated.
Cash payments, including remaining amounts, if the voucher value exceeds the amount to be paid, or exchanging the vouchers for product vouchers in the online shop are not possible.
The vouchers are personal and non-transferable. If lost or stolen, the voucher will not be replaced.

8. Subscriptions
Subscriptions can only be used for the specified services/treatments. They cannot be offset against other services/treatments. Subscriptions are personal and cannot be transferred. Subscriptions expire no later than 18 months after they are issued. Paid subscriptions cannot be refunded.

9. Data Protection
Your personal data will always be treated confidentially and used and processed exclusively in accordance with applicable data protection laws.
The customer agrees that his personal data can be used for advertising for our own and third-party purposes (e.g. delivery of a customer newsletter and participation in our own competitions). The customer can prohibit the processing of personal data at any time without giving reasons and revoke the consent given for the future.

10. Release from medical professional secrecy
In order to carry out the treatments, ivilounge is required to process the health information of its customers, which may be subject to professional secrecy (Article 321 of the German Criminal Code). The customer expressly releases the doctors and employees of ivilounge, insofar as they are subject to professional secrecy, from their professional secrecy with regard to all information and documents that he makes available to ivilounge.
The customer agrees that
Ivilounge forwards the data required for invoicing and debt collection to the (name/address of the clearing office) or to its debt collection office (name/address of the clearing office’s debt collection partner),
in the event of persistent default in payment, can provide the debt collection office with the information required for enforcement and
Ivilounge can provide the competent court with the information necessary to enforce the fee claim.

11. Follow-up treatments for hyaluronic acid and muscle relaxant
Follow-up treatments for hyaluronic acid and muscle relaxant are possible free of charge within 14 working days (not working days). From the 15th weekday up to and including the 30th weekday after the treatment, a discount of 50% on the official treatment price can be given. Follow-up treatment after the 30th weekday is to be charged in full. The "muscle relaxant" consumption per region must be adhered to. If "muscle relaxant" is consumed more than 10 units, an additional charge of CHF 5 per unit is to be charged. The hyaluronic acid consumption per region must be adhered to. If it is consumed more than 0.5 ml, an additional charge of CHF 125 per unit is to be charged.

12. Self-paid services
All services provided by ivilounge GmbH are exempt from cost sharing by health insurance companies. All services are self-pay services.

13. Final provisions, place of jurisdiction and applicable law
Should any provision be or become invalid, this shall not affect the validity of all other provisions or agreements.
The court in Zurich has jurisdiction for disputes. Swiss law applies.
